The Supreme Court of Canada has established that commercial speech is protected under the Canadian Charter of Rights and Freedoms and that commercial speech exists along a continuum of utility and value, which is balanced against objectives such as public health. This article examines jurisprudence to determine when infringements on commercial speech are acceptable, analyzing considerations of evidence, rational connections between policies and outcomes, proportionality, and minimal impairment.

The relationship between stress and unethical behaviour amongst non-tenured research staff in academia is a relatively unexplored phenomenon. The research reported herein was therefore carried out with the aim of exploring the relationship between stress, the socio-organisational factors which contribute to it, job satisfaction, perceptions of job instability, and the occurrence of unethical behaviour in research. 793 Italian researchers participated in the research—all of whom were working on fixed-term contracts—after being individually requested to complete an online questionnaire. The data indicate (...) that unethical behaviours occur with alarming frequency. The stress level reported is quite high, as is the level of perceived job insecurity, both of which impact upon levels of job satisfaction. Perceived stress levels also seem to play a role in the commission of unethical behaviours, but this relationship is irrelevant when one considers the role of social and organisational factors that are known to induce it. Indeed, it seems that there are various socio-organisational determinants of stress that have an obvious direct negative influence on the commission of unethical behaviours more than the stress level per se. This research paints a worrying picture in relation to the psycho-physical state of non-tenured researchers as a result of the working conditions in which they find themselves in Italian universities. Svrha i cilj ovog članka sastoji se u pokušaju ukazati na važan doprinos Karola Wojtyle razvoju dijaloga između klasične filozofije i moderne misli, te klasične filozofije i znanosti, posebice na području etike.Pritom se analize oslanjaju poglavito na dio »Lublinskih predavanja« naslovljenih 'Čin i doživljaj' koja je Wojtyla kao mladi docent držao tijekom 1954/55. godine na Filozofskom fakultetu Katoličkog sveučilišta u Lublinu. Ta su predavanja paradigmatična za Wojtylin dijalog sa suvremenom mišlju i znanošću. U njima se Wojtyla bavi razlikom između psihologijskih (...) i etičkih analiza volje kako bi razjasnio strukturu etičkog čina. Temeljem usporedne analize pozicije modernog pravca eksperimentalne psihologije volje i shvaćanja koja susrećemo u Tome Akvinskog, Wojtyli je uspjelo ukazati ne samo na moguće konvergentne točke između tih analiza, nego i na razlike koje su neizbježne. Njegov dijalog sa koncepcijom modernog pravca psihologije volje bio je plodan za osvjetljavanje značenja metafizičke koncepcije volje Tome Akvinskog kao i za razmatranje problema razdvajanja doživljaja i čina u etičkim teorijama I. Kanta i M. Schelera.Ziel und Zweck dieses Artikels liegen in dem Versuch, auf den wichtigen Beitrag Karol Wojtylas zur Entwicklung des Dialogs zwischen der klassischen Philosophie und des modernen Denkens, sowie zwischen der klassischen Philosophie und der Wissenschaft, besonders auf dem Gebiet der Ethik, hinzuweisen.Die Analysen stützen sich vor allem auf den Teil der Lubliner Vorlesungen mit dem Titel Akt und Erlebnis, die er als junger Dozent an der Philosophischen Fakultät der Katholischen Universität Lublin hielt. Diese Vorlesungen sind paradigmatisch für Wojtylas Dialog mit dem modernen Denken und der Wissenschaft. In diesen Vorlesungen befasst sich Wojtyla mit den Unterschieden zwischen den psychologischen und philosophischen Analysen des Willens, um die Struktur des ethischen Aktes zu erklären. Aufgrund der komparativen Analyse der Position der modernen Richtung der eksperimentellen Willenspsychologie und der Auffassungen, denen wir bei Thomas von Aquin begegnen, gelang es Wojtyla nicht nur auf mögliche konvergente Punkte zwischen diesen Analysen hinzuweisen, sondern auch auf die Unterschiede, die unausweichlich sind. Wojtylas Dialog mit der Konzeption der modernen Richtung der Willenspsychologie war fruchtbar sowohl für die Erhellung der Bedeutung der metaphysischen Konzeption des Willens von Thomas von Aquin, als auch für die Erörterung des Problems der Trennung von Erlebnis und Akt in den ethischen Theorien von I. More than one third of the human brain is devoted to the processes of seeing - vision is after all the main way in which we gather information about the world. But human vision is a dynamic process during which the eyes continually sample the environment. Where most books on vision consider it as a passive activity, this book is unique in focusing on vision as an 'active' process. It goes beyond most accounts of vision where the focus is on (...) seeing, to provide an integrated account of seeing AND looking. The book starts by pointing out the weaknesses in our traditional approaches to vision and the reason we need this new approach. It then gives a thorough description of basic details of the visual and oculomotor systems necessary to understand active vision. The book goes on to show how this approach can give a new perspective on visual attention, and how the approach has progressed in the areas of visual orienting, reading, visual search, scene perception and neuropsychology. Finally, the book summarises progress by showing how this approach sheds new light on the old problem of how we maintain perception of a stable visual world. This paper is a critical discussion of A.N. Prior’s contribution to the modern understanding of indeterminism and human freedom of choice. Prior suggested that these ideas should be conceived in terms of his tense logic. It can be demonstrated that his approach provides an attractive formalization that makes it possible to discuss indeterminism and human freedom of choice in a very precise manner and in a broader metaphysical context. It is also argued that Prior’s development of this approach was closely (...) linked to his very personal struggles with fundamental religious and metaphysical questions. In his opinion, holding the doctrine of divine foreknowledge together with the doctrine of human freewill gives rise to difficult logical and philosophical problems. It appears that Prior, rather early on, decided to support what was later known as the Peircean solution, although he also analysed what he considered to be the most important alternative solution—the Ockhamist solution. This paper offers a discussion of some of Prior’s published books and papers as well as some of the papers in his Nachlass. (shrink)

This paper concerns a puzzle about the logical form of expressions involving repeated `and's. Obvious attempts to solve the problem fail. It happens that a proper solution surprisingly requires the semantic notions of sampling and expression. I speculate that this may provide an alternative to conversational implicature.

_Background:_ Cognitive biases play an important role in the formation and maintenance of delusions. These biases are indicators of a weak reflective mind, or reduced engaging in reflective and deliberate reasoning. In three experiments, we tested whether a bias to accept non-sense statements as profound, treat metaphorical statements as literal, and suppress intuitive responses is related to psychotic-like experiences. _Methods:_ We tested deliberate reasoning and psychotic-like experiences in the general population and in patients with a former psychotic episode. Deliberate reasoning (...) was assessed with the bullshit receptivity scale, the ontological confabulation scale and the cognitive reflection test (CRT). We also measured algorithmic performance with the Berlin numeracy test and the wordsum test. Psychotic-like experiences were measured with the Community Assessment of Psychic Experience (CAPE-42) scale. _Results:_ Psychotic-like experiences were positively correlated with a larger receptivity toward bullshit, more ontological confabulations, and also a lower score on the CRT but not with algorithmic task performance. In the patient group higher psychotic-like experiences significantly correlated with higher bullshit receptivity. _Conclusion:_ Reduced deliberate reasoning may contribute to the formation of delusions, and be a general thinking bias largely independent of a person's general intelligence. Acceptance of bullshit may be facilitated the more positive symptoms a patient has, contributing to the maintenance of the delusions. (shrink)

Some theorists, worried about liberalism’s potential as a foundation for public health ethics, suggest that republicanism provides a better background of justification for public health policies, interventions, etc. In this article, this suggestion is put to the test, and it is argued that (i) contemporary (civic) republicanism and liberalism are not nearly as opposed as it is sometimes suggested, and that (ii) the kind of republicanism which one leading scholar in the field, Bruce Jennings, as an alternative to liberalism, does (...) not reflect the contemporary understanding of republicanism as held by, e.g. Phillip Pettit et al. This paper defends the acts/omissions distinction which underpins the present law on euthanasia, from various criticisms, and aims to show that it is supported by fundamental principles. After rejecting arguments that deny the coherence and/or legal relevance of the distinction, the discussion proceeds to focus on the causal relationship between the doctor and the patient's death in each case. Although previous analyses, challenging the causal efficacy of omissions generally, are shown to be deficient, it is argued that in certain cases (...) of causing death by omission the causal authorship of the doctor lapses. The final part of the paper examines why this should be morally significant and proposes an answer in terms of the principle of equality. Assuming all other factors are equal, the infringement of this principle provides an additional reason against actively killing a patient, which is not present in cases of passively letting die. The considerable attention to financial interests in clinical research has focused mostly on academic medical centers, even though the majority of clinical research is conducted in community practice settings. To fill this gap, this article maps the practices and policies in 73 community hospitals and several hundred specialized facilities around the country for reviewing clinical investigators’ financial relationships with research sponsors. Community hospitals face a substantially different mix of issues than academic medical centers do because their physician researchers are usually (...) not employees, and more of their studies are later-phase, multicenter trials. Accordingly, community physicians stand to benefit personally from per capita payments, but they tend to have less direct influence over research findings when compared with their academic peers. These and other contrasts require separate guidance for community-based organizations that takes into account their particular needs, circumstances, and institutional capacities. (shrink)

Contrary to spontaneous yawning, which is widespread in vertebrates and probably evolutionary ancient, contagious yawning—yawning triggered by others’ yawns—is considered an evolutionarily recent phenomenon, found in species characterized by complex sociality. Whether the social asymmetry observed in the occurrence of contagious yawning is related to social and emotional attachment and may therefore reflect emotional contagion is a subject of debate. In this study we assessed whether yawn contagion was enhanced in pregnant women, a cohort of subjects who develop prenatal emotional (...) attachment in preparation for parental care, via hormonal and neurobiological changes. We predicted that if yawn contagion underlies social and emotional attachment, pregnant women would be more likely to contagiously yawn than nonpregnant, nulliparous women of reproductive age. We gathered data in two different settings. In the experimental setting, 49 women were exposed to video stimuli of newborns either yawning or moving their mouth and we video-recorded the women during repeated trials to measure their yawning response. In the naturalistic setting, 131 women were observed in a social environment and their yawning response was recorded. We tested the factors influencing the yawning response, including the reproductive status. In both settings, yawn contagion occurred significantly more in pregnant than nonpregnant women. By showing that pregnant women were most likely to respond to others’ yawns, our results support the hypothesis that the social variation observed in yawn contagion may be influenced by emotional attachment and that yawning in highly social species might have been coopted for emotional contagion during evolution. Neobiota as non-native species are commonly considered as alien species. The Convention on Biological Diversity (CBD) intends to “prevent the introduction of, control or eradicate those alien species which threaten ecosystems, habitats or species”. The European Union has financed the DAISIE research project for the first pan-European inventory of Invasive Alien Species (IAS), which is supposed to serve as a basis for prevention and control of biological invasions. This paper discusses the evaluation approach for classifying “100 of the Worst” IAS (...) in Europe by the EU DAISIE research project. The main impact categories used by DAISIE for assorting “100 of the Worst” IAS are investigated and the texts of the “Wanted” species factsheets are examined. Two examples from the DAISIE factsheets of the “100 of the Worst” IAS [Tree of Heaven ( Ailanthus altissima ) and the Raccoon ( Procyon lotor )] are discussed to illustrate DAISIE’s biodiversity evaluation approach in more detail. However, the classification criteria used by DAISIE do not allow for sufficiently differentiating these neobiota from an ecological behavior of native species with a similar ecological niche. In conclusion, neobiota evaluations are not comprehensive when they refer mainly to the successful expansion and competition with native species into available ecological niches. A comprehensive assessment of the impacts of neobiota on biodiversity and humans needs to take into account the different values of biodiversity as mentioned in the preamble of the CBD. (shrink)
